The Minister for Planning approved Amendment C140 to the Whitehorse Planning Scheme on 21 March 2013. The amendment came into effect on this date, and Notice of Approval was also published in the Government Gazette on this date. The amendment introduces heritage overlay controls to 25 places (comprising 24 individual places and 1 heritage precinct) across the municipality.
Amendment C140 was on public exhibition from 31 March–13 May 2011. At its meeting on 27 June 2011, Council resolved to request an independent panel hearing from the Minister for Planning.
The panel was appointed and heard submissions on 11, 12 and 13 October 2011, at the Whitehorse Civic Centre, Whitehorse Road, Nunawading.

Council considered the panel report at its meeting on 20 February 2011, adopted the amendment with all but two of the changes recommended by panel and resolved to send the amendment to the Minister for Planning for approval.
