A request was submitted by James Livingston Planning to Council to consider a planning scheme amendment to rezone the site at 35 Hay Street, Box Hill South. The amendment proposes to introduce Schedule 6 to the General Residential Zone into the Whitehorse Planning Scheme and rezone 35 Hay Street, Box Hill South from the Special Use Zone (Schedule 2) to the General Residential Zone (Schedule 6).
At its meeting on 20 October 2014, Council resolved to seek authorisation to prepare and exhibit a planning scheme amendment.
Submissions were received between 5 February and 6 March 2015.
At its meeting on 20 April 2015, Council resolved to request the Minister for Planning appoint an Independent Panel to consider the Amendment and all submissions in accordance with the Planning and Environment Act 1987.
The directions hearing was held on 27 May 2015 and the panel hearing was held on 23 June 2015. Council has received the Panel Report and a copy of the report has been sent to those who presented at the Panel Hearing. The Panel Report is available for download here:

At its meeting of 17 August 2015 Council adopted the amendment, and it was referred to the Minister for Planning for approval shortly after. The amendment came into effect on 14 January 2016, being the date of publication in the Government Gazette.
