Rezoning of 217 and 219-223 Burwood Highway, Burwood East

The Minister for Planning approved Amendment C182 to the Whitehorse Planning Scheme on 22 June 2017. The amendment itself came into effect on this date, being the date the Notice of Approval was published in the Government Gazette.

The amendment proposes to rezone two properties at the intersection of Burwood Highway and Blackburn Road from the Residential Growth Zone (Schedule 2) to the Mixed Use Zone and apply an Environmental Audit Overlay to both sites.

The rezoning of the sites to the Mixed Use Zone will allow the sites to be developed for commercial and retail uses that serve the immediate and broader area.

The application of an Environmental Audit Overlay to both sites is a result of the current use of 217 Burwood Highway as a petrol station and the former use of 219-223 Burwood Highway as a petrol station. The Overlay will ensure any future sensitive use of the land will be suitably protected from potential contamination resulting from the former use of the site

Amendment C182 was on public exhibition from Thursday 19 November 2015 until Monday 21 December 2015. At a meeting on 1 February 2016 Council resolved to request the appointment of an independent Planning Panel to consider the amendment and the submissions received to the amendment.

The Panel held a Directions Hearing at the Whitehorse City Council Civic Centre on 21 March 2016 and a Panel Hearing was held on 21 and 22 April 2016 at the Box Hill Town Hall.

Council considered the Panel Report at its meeting on 27 June 2016 and resolved to adopt the Amendment as exhibited. Council also resolved to submit the amendment to the Minister for Planning for Approval. Amendment C182 approved documentation can be viewed below:
