The planning scheme amendment affects the land located at 517 and 519-521 Station Street, Box Hill and 2-8 Oxford Street, Box Hill and the planning permit application affects land located at 517 and 519-521 Station Street, Box Hill.
The planning scheme amendment proposes to rezone the land at 517 and 519-521 Station Street, Box Hill from the Public Use Zone to the Mixed Use Zone (MUZ); rezone the land at 2-8 Oxford Street Box Hill from the Residential Growth Zone to the MUZ; amend the Schedule to Clause 52.03 to include the Incorporated Document entitled “517 and 519-521 Station Street, Box Hill, December 2016” and amend the Schedule to Clause 81.01 to include the Incorporated Document entitled “517 and 519-521 Station Street, Box Hill, December 2016”.
The planning permit application for 517 and 519-521 Station Street, Box Hill seeks approval for the construction of three buildings (2 buildings up to 18 storeys and 1 building up to 6 storeys) including up to 3 levels of basement car parking and comprising retail premises, offices, restricted recreational facility (gymnasium), medical centre, accommodation, serviced apartments and a child care facility. The land at 2-6 Oxford Street, which contains the Uniting Church, is not included in the planning permit application.
The planning permit application also seeks approval for a reduction in the standard requirements for car parking facilities and alteration of access to a road in a Road Zone, Category 1.
The amendment and application has been requested by Golden Age Station Street Box Hill Development Pty Ltd under section 96A of the Planning and Environment Act 1987. At the meeting on 20 February 2017, Council resolved to seek authorisation from the Minister for Planning to prepare and exhibit the combined planning scheme amendment and planning permit application.

Exhibition was for one calendar month and took place from Thursday 27 April until Monday 29 May 2017. Exhibition involved the direct notification of owners and occupiers of properties surrounding the subject sites, totalling 2,684 letters. The notification of properties in the area included a cover letter explaining the Amendment, the draft planning permit conditions and the statutory notice of Amendment. Relevant Ministers, public and referral authorities were also notified, together with the publication of the Notice of Preparation of Amendment in the Whitehorse Leader on 24 April 2017 and the Government Gazette on 27 April 2017.
For the duration of the exhibition period copies of the Amendment documents were available for viewing on Council’s website and in hardcopy at Council’s Civic Centre in Nunawading, Council’s Box Hill and Forest Hill Service Centres and the libraries in Whitehorse.
During the exhibition period Council officers received several phone and counter inquiries regarding the Amendment. Fifty-three (53) submissions were received to the Amendment including 19 pro-forma submissions and two late submissions, one being a petition with 98 signatories (noting that under the Planning and Environment Act 1987, a petition is treated as a single submission, as is the case in an ordinary planning permit application), and one being a pro-forma submission. The submissions were received from public authorities, local residents, local workers and business owners/operators.

An independent Planning Panel was appointed by the Minister for Planning and a Directions Hearing was held on 24 August 2017. The Panel Hearing will be held over five days and will commence at 9.30am on Monday 2 October 2017 in the Whitehorse Room at the Box Hill Town Hall, 1022 Whitehorse Road, Box Hill. Expert witness reports that are to be relied on at the hearing will be made available after 22 September on Council’s website and at the Nunawading and Box Hill service centres.
