Barking Dog Complaints
If you are annoyed by a barking dog, try talking to the owner about the problem first. Give them a chance to fix the problem. This may take some time, so try to be patient. If the problem continues, you can contact Council and be advised of the correct process to follow.
Dogs, by their very nature bark. Some possible reasons may be from:
- Boredom
- Intruders
- Lack of exercise
- Cats, possums, other dogs or birds
While it is acceptable for a dog to bark to warn its owner of an intruder, it is the owner's responsibility to train the dog not to bark at 'normal' occurrences such as possums, cats or birds.
Barking at normal movements or noises from adjoining properties should be considered to be unacceptable behaviour.
The dog's owner may not realise that the barking is causing an annoyance to other people due to the following reasons:
- The dog may only bark excessively when the owner is not home
- The owner may not hear the barking from various areas within their house
- The owner may be a very sound sleeper and not woken when the dog barks
A pet owner has the responsibility to ensure that their animal does not become a nuisance. If the problem continues and you wish to lodge a complaint, click here to download the Barking Dog Nuisance Log Form.
Please note the log must be completed accurately as the information you provide may be used in court should the matter escalate.
Council will advise you to take the matter to court if:
- It is fully established that there is a case to answer
- All avenues for reconcillation of the problems are exhausted
- More than one person is prepared to go to court and give evidence as well
Council will not get involved in any domestic dispute between you and your neighbour. If this happens, Council will inform you that you have the right to seek independant legal action. Any action can be costly. It is recommended you seek independant legal advice.
