Local Law, FRV or EPA Fines - Invalid Reasons for Fine Withdrawal

Follow these steps to determine if you able to successfully apply for the withdrawal of a City of Whitehorse Local Law, Fire Rescue Victoria (FRV) or Environmental Protection Authority (EPA) fine.

Step 1

Review the list of reasons that are not considered valid in having a Local Law, FRV or EPA fine withdrawn

Below are common reasons used to request Council to withdraw City of Whitehorse Local Law ( PDF 280.06KB), Environmental Protection Authority or Fire Rescue Victoria fine. None of them are valid reasons to withdraw the fine:

  • Believing that it is unconstitutional for a Council to issue a fine
  • Being a first offence or having an excellent record before the issuing of the fine
  • I didn’t know it was a problem
  • I didn’t know the law or Local Law
  • The alleged offence is not the building company’s responsibility, it was the tradesmen who breached the requirements
  • The alleged offence is not the property owner’s responsibility, it is the responsibility of the tenant who has since left the property and the owner does not know where they have gone
  • I did not understand the "Notice to Comply, Fire Prevention Notice"
  • English is not my first language and I did not understand my responsibilities
  • Being new to the area and unfamiliar with the Local or Victorian Law requirements/responsibilities for building sites, maintaining my property. This includes if the resident is from Victoria, interstate or overseas
  • Being out of the state or overseas when a "Notice to Comply" or "Fire Prevention Notice" is due
  • Being on a restricted income or having insufficient funds to pay the fine
    Note: Victorian legislation does not allow for student or pensioner discounts for fines. A payment arrangement (extension in time to pay the fine) is available in these cases.
