Camping and Caravans

The Whitehorse Community Local Law 2024 ( PDF 973.95KB) has restrictions on storage of caravans and camping in the City of Whitehorse.

Caravans

Under the Whitehorse Community Local Law 2024 ( PDF 973.95KB), a resident may not, without a permit:

On Council land, a road or in a Public Place, store, keep or allow to be placed caravan for longer than 14 continuous days (S3.8).
On any land, store more than one caravan (S 3.11).

More than One Caravan Permit Conditions and Condition Breaches

The permit holder must ensure that all the permit conditions are complied with at all times.
The permit holder must provide evidence of $20 million of public liability insurance for the permit period.
The permit is not transferrable:
- Permits are not to be photocopied or used by someone not named on the permit
- Permits are not to be leased, sold or given away
- No form of advertising of a permit for rent, lease, sale profit or other beneficial or fraudulent consideration of causing such an advertisement to be published is permitted.
Only one additional caravan is permitted, resulting in a maximum of two caravans.
The additional caravan may only be placed on the property for a maximum period of six (6) months.
All waste generated from caravans is to be disposed in an approved system.
There is no breach of the Road Safety Act 1986 or any Relevant Regulation.
Caravans must not be:
- Unregistered, un-roadworthy, dissembled, incomplete or deteriorated for more than two (2) months when stored on the land
- Make the land visibly repugnant or detrimental to the general amenity of the area (Refer Whitehorse Community Local Law 2024 ( PDF 973.95KB) S3.1).
The permit holder or their representative must comply with any parking regulations in the area if required, unless otherwise agreed to by Council. A permit will not override any clearway or freeway parking restrictions.
Manholes, hydrants, telephone boxes, taxi ranks and tram and bus stops may not be obstructed.
The permit does not entitle the permit holder to cause danger to the normal flow of traffic or restrict traffic movements.
Council will NOT allow, without a valid Council permit, the installation of permanent structures on Council land.
At the conclusion of the permit period a new application form must be submitted.
The permit must be produced for an Authorised Council Officer on request.
The permit holder will comply with all directions by a member of Victoria Police or Authorised Council Officer, including a direction that the permitted activity cease and any related plant or equipment be removed.

Camping

The Whitehorse Community Local Law 2024 ( PDF 973.95KB) allows for camping on land under limited circumstances:

The owner or occupier of land must not camp, or allow any other person to camp, on that land in a manner that causes a nuisance (S3.14)
A person must not, without a permit, camp in a tent, vehicle, caravan or any other temporary or makeshift accommodation on Council land or in a Public Place (S2.6).

NOTE: Camping means the occupation or use of a tent, annexe or similar structure, sleeping bag, caravan, mobile home or other moveable vehicle for accommodation.

Camping on Council Land Permit Conditions and Breaches

The permit holder must ensure that all the permit conditions are complied with at all times.
The permit holder must provide evidence of $20 million of public liability insurance for the permit period.
The permit is not transferrable:
- Permits are not to be photocopied or used by someone not named on the permit
- Permits are not to be leased, sold or given away

The length of time camping is taking place is less than six (6) months after which a new permit application must be lodged.
All waste is to be disposed of in an approved system.
No nuisance or public health or safety hazards are created by the camping activity.
No open fires may be lit without a separate permit.

Rough Sleeper Camping

The need to camp in a public place may vary however, many of the people who camp in public places are homeless. They can be referred to the open door entry point for homeless people for the City of Whitehorse:
