The Amendment applies to the following three lots, as shown on the map below:

• 490-500 Burwood Highway, Vermont South;
• Flat 1/490-500 Burwood Highway, Vermont South;
• Flat 2/490-500 Burwood Highway, Vermont South.

The Amendment rezones the land from Transport Zone Schedule 4 (TRZ4) to Residential Growth Zone Schedule 3 (RGZ3). It also applies the following overlay controls to the land:

• Significant Landscape Overlay and a new Schedule 10 (SLO10) (Former Australian Road and Research Board site, 490-500 Burwood Highway, Vermont South);
• Vegetation Protection Overlay Schedule 5 (VPO5) (Significant, exotic, native and indigenous trees);
• Design and Development Overlay and a new Schedule 6 (490-500 Burwood Highway, Vermont South (DDO6) (Former Australian Road and Research Board site));
• Environmental Audit Overlay.

In addition to the above mentioned zone and overlay changes, the Amendment makes minor adjustments to the Housing Framework Plan at Clause 21.06 to include the land within a Substantial Change Area, and Map 1: Neighbourhood Character Precincts at Clause 22.03, to include the land in the Garden Suburban 7 precinct. The Amendment also inserts a new Statement of Significance under the Schedule to the Heritage Overlay for HO23 (Australian Road and Research Board).

The land affected by the Amendment was in the Transport Zone 4 (TRZ4) and was no longer required for a public use associated with a transport purpose. The land is now in private ownership and the TRZ4 has subsequently become redundant.

The TRZ4 only enables a limited range of uses associated with a transport use that is carried out by or on behalf of the relevant transport manager. As the Australian Road and Research Board has vacated the site, it is no longer used for a public, transport related use. A rezoning was therefore required to enable a new use and development to establish on the site.

The Amendment facilitates the future residential development of the land. The controls intend to enable the development of a new residential neighbourhood in a well serviced area of Vermont South. The DDO6 sets out a range of design requirements, including in relation to heights, ground and upper level setbacks, viewlines, building separation and open space.  

The Amendment does not include approval of a proposed development. Any future development would still need to go through the planning permit application process before it can proceed. 

The time for making submissions has now closed.

Submissions were received from 2 June until 5 July 2022.

Exhibition of Planning Scheme Amendment C230whse ran from Thursday 2 June until Tuesday 5 July 2022. The submission period is now closed.

Council considered submissions received in relation to the Amendment at its meeting on 26 September 2022. Council's decision at this meeting was to request the Minister for Planning to appoint an independent planning panel to review the Amendment and hear all submissions.

A Directions Hearing was held on 28 October 2022 and the Panel Hearing was held from 7 February to 10 February 2023.

Council considered the Panel Report and the Amendment at its meeting on 10 July 2023 and decided to adopt the Amendment with changes. The Amendment was submitted to the Minister for Planning for approval after the Council meeting.

Amendment C230whse has now been approved by the Minister and came into effect on 27 March 2024.
