The information that you will need to include will vary depending on what you are seeking a permit for; however, the minimum information that must be submitted is as follows:
- Completed permit application form including brief description of noncompliance
- Full payment of appropriate application fee
- A current and full copy of title (including title plan) and details of any restrictive covenants or other restrictions on the title. This title must have been searched within the last two months (Note: you can obtain a copy of title on the Landata website.) Further information to assist in this process is available at 'Request a Copy of Title'.
- Completed covenant declaration form (not required if lodged online)
- A cover letter/submission requesting the report and consent of Council to vary the specific building regulation that outlines the reasons for the request
- Electronic copy plans for the proposed construction with the area(s) of noncompliance clearly identified
If advertising is required and you as the applicant are notifying owners of adjoining properties, you must ensure the advertising material adequately reflects the nature of the proposal and extent of noncompliance(s). All adjoining property owner(s) comments must demonstrate an understanding of the nature of the proposal and how it is non-compliant. Council can undertake this process at the request of the applicant and payment of advertising fees.
Documents submitted must be in pdf format and should be labelled as follows:
Property Address - Document Name
For example: 2/1000-1004 Whitehorse Rd, Box Hill – Plans
Failure to provide any application requirements will result in a delay to the processing/assessment of an application and may also result in a decision to refuse the proposal.
Please refer to Council's checklist for specific information about what needs to be included for a report and consent application.
